New York City and its public hospital system defeated an attempt to revive the age and race bias claims of nearly a dozen former employees when an appellate court affirmed the workers lacked evidence.
The workers allege New York City Health and Hospitals Corp. disproportionately terminated non-White employees and employees over 40 when it eliminated some managerial roles at an acute care facility. The workers didn’t put forth enough evidence to get their disparate impact allegations to trial, the US Court of Appeals for the Second Circuit said Wednesday in an unpublished opinion.
