A South Dakota federal district court granted summary judgment to an Indian national PhD graduate and postdoctoral fellow, on her Administrative Procedure Act claim challenging the Department of Homeland Security’s termination of her SEVIS immigration record, ruling that defendants’ decision was arbitrary and capricious because they failed to identify any regulation authorizing termination based on her dismissed DWI charge and traffic violation.
