A California federal jury determined that the plaintiff, veterinary drug company Tevra Brands LLC, failed to prove that the “relevant antitrust market” was topical imidacloprid flea and tick products for cats and dogs in the US.
Because of the finding on this threshold question, the jury didn’t even reach other questions like whether Bayer had market power or whether its conduct was anti-competitive.
