The Ninth Circuit affirmed the decision of the District of Arizona denying MFIB LLC’s motion for a preliminary injunction barring IBCA LLC from using the trademarks “Icon,” “Icon Builders,” and “The Original Icon Builders.” The appeals court found that IBCA had senior rights over MFIB’s registered marks and that MFIB lacked evidence of current use by IBCA outside prior use areas.
