A consumer alleging Folger Coffee Co. overstates how many cups its ground coffee canisters brew didn’t satisfy requirements to represent a class of Missouri purchasers, the Eighth Circuit said Wednesday.
Many proposed class members weren’t deceived, and determining who was “will require consumer-by-consumer inquiries into each class member’s individual tastes, interpretations, and circumstances,” the US Court of Appeals for the Eighth Circuit said.
