OpenAI Pushes Back on ‘Erroneous’ Discovery Order in NYT Lawsuit

OpenAI Inc. insisted a federal judge vacate a recent order and force the New York Times Co. to hand over information on its own use and development of generative AI tools because that information “directly relevant” to the case.

Magistrate Judge Ona T. Wang’s Nov. 22 order denying OpenAI’s motion to compel the Times to hand over those details “misapprehends the fair use inquiry in multiple respects,” OpenAI argued in a memorandum supporting a notice of objection filed in the US District Court for the Southern District of New York.
