Possible Data Center Rules Evoke Tension Over State Jurisdiction

The Energy Department’s request for the Federal Energy Regulatory Commission to look into speeding up connecting data centers to the grid received a large response from stakeholders, with several expressing concern over infringing on state decisions.

PJM Interconnection LLC, one of the more than 100 entities that submitted comments to FERC, said the jurisdictional divide is likely to cause “protracted litigation and regulatory uncertainty.”

The question remains as to whether any rule would “entangle the Commission and stakeholders in a potentially contentious dispute that would distract from” achieving “timely and orderly large load interconnections,” said PJM, which manages the grid ...
