The founder of bankrupt Nikola Corp. said President Donald Trump’s pardon of his criminal charges means his nearly $70 million claim against the electric-vehicle maker can’t be subordinated in the company’s liquidation plan.
Nikola’s attempt to deprioritize Trevor Milton’s claim for legal fees and related costs should be rejected because Trump deemed him “factually innocent,” the former CEO told the US Bankruptcy Court for the District of Delaware in a Wednesday filing.
Milton was sentenced in December 2023 to four years in prison after a jury found him guilty of securities and wire fraud. Trump pardoned him in March.
