Johnson & Johnson can avoid a proposed class action to cover medical screening costs incurred by individuals worried about developing ovarian or gynecological cancers from using J&J talc products, a New Jersey federal judge ruled, finding no concrete injury was alleged.

Lacking a cancer diagnosis, lead plaintiff Joni Bynum hasn’t plausibly alleged an economic injury caused by J&J or provided enough basis to support a medical monitoring claim under New Jersey or Washington state law, Judge Michael A. Shipp of the US District Court for the District of New Jersey ruled Thursday.
