Bal Harbour Shops LLC, an outdoor shopping center in Miami, asked to lift certain bankruptcy protections for Saks Global Enterprises LLC in order to proceed to trial in a long-running eviction suit seeking six years of unpaid rent.
Saks Fifth Avenue, an anchor tenant at the upscale mall, should be required to proceed to trial in Florida state court over its refusal to pay rent due to business closures during the Covid-19 pandemic, Bal Harbour said in a filing Tuesday with the US Bankruptcy Court for the Southern District of Texas.
