BGOV Bill Analysis: H.R. 6260, Bail Fund Fraud Regulations

The business of cash bail and bail bonds would be subject to federal insurance fraud laws under H.R. 6260.

The bill would amend current law, which makes it a criminal offense for insurers that conduct interstate business to make fraudulent statements and reports, to define monetary bail, criminal bail bonds, and federal immigration bail bonds as insurance products.

The change is aimed at better regulating nonprofit bail funds — charitable organizations that collect public donations to post cash bail for individuals who can’t afford to — according to the House Judiciary Committee report on the bill.
