BGOV Bill Analysis: H.R. 6398, Nix EPA Review of Agency Actions

The Environmental Protection Agency would no longer have to review environmental impact statements for federal construction projects, proposed agency regulations, and major federal actions under H.R. 6398.

Agencies are required under the National Environmental Policy Act to prepare environmental impact statements for actions that are determined to significantly affect the environment. As part of the process, EPA must separately review and comment on those statements, which detail the action’s environmental effects.

The bill would strike mandated EPA reviews for most agency actions, while preserving the review requirement for any legislation proposed by a federal agency.
