How a Post-Jan. 6 Law Maps Out the Presidential Transition (1)

A new law designed to ease the presidential transfer of power creates the possibility that both candidates will lead dueling transition teams in the weeks after Election Day.

That’s because Congress passed a law (Public Law 117-328) in 2022 to make it harder for future commanders-in-chief to hold up the president-elect’s access to federal funds and agency information, as former President Donald Trump did in the last election. The law directs the General Services Administration to provide “equal” support to both candidates beginning five days after Election Day until there is a clear winner.
