Jurisdictional Questions Sink Disability Discrimination Lawsuit

District courts don’t have jurisdiction over a man’s disability discrimination lawsuit since diversity jurisdiction doesn’t extend to the federally incorporated scientific organization he’s suing, a split federal appeals court ruled Monday.

New York-resident Arnold Schneiderman’s lawsuit against the American Chemical Society will have to take place in state court since the society is a federally incorporated corporation. This federal incorporation undercuts the law governing that diversity jurisdiction applies to corporations that have both state incorporation and a state-based principal place of business, Judge Reena Raggi said.
