Brooklinen Inc. will defend against a proposed consumer class action over its online prices in federal court after a judge determined the company’s motion to remove the case to a California court was timely.
Brooklinen’s removal of the case also meets appropriate requirements because the company established that the “amount-in-controversy” exceeds $5 million, said Judge Robert S. Huie of the US District Court for the District of Southern California in a Dec. 24 opinion, denying the plaintiffs’ motion to remand.
