Call Center Workers Get Boot-Up Time Wage Suit Revived on Appeal

Las Vegas call center workers won another shot at a wage-and-hour suit after the Ninth Circuit on Monday ruled time spent booting up work computers is an integral and indispensable part of their jobs.

The lower court granted Customer Connexx LLC an early win after it determined that logging on and off weren’t part of the workers’ principal job activities. But all of the workers’ calls are routed through their computers, making starting the computers “integral and indispensable” to their duties and a principal activity under the Fair Labor Standards Act, the US Court of Appeals for the Ninth Circuit ...
