A road construction company trying to revive a bid to eject its workers’ union ran into resistance from a federal appellate court dubious about its jurisdiction to consider the issue.
During oral argument Thursday, Rieth-Riley Construction Co. told the US Court of Appeals for the Sixth Circuit that the National Labor Relations Board’s decision that the company illegally withdrew recognition from a union provided a vehicle to challenge the board’s dismissal of a union decertification petition.
