Drivers Ask Justices to Ax Industry Test in Arbitration Dispute

Drivers who deliver baked goods for Flowers Foods Inc. urged the US Supreme Court to put the brakes on the inclusion of a transportation-industry requirement in an exemption to federal arbitration laws.

There’s “no basis” in the Federal Arbitration Act’s text for the requirement that people engaged in interstate transportation must also be employed by a company in the transportation industry to take advantage of an exemption for transportation workers, the drivers said in a brief filed with the high court on Monday.
