Fired NLRB Member Asks Full D.C. Circuit to Review Case First

A National Labor Relations Board member fired by President Donald Trump asked the full D.C. Circuit to hear her case challenging her termination instead of having a three-judge panel of the court conduct the initial review.

A district court previously ruled that Gwynne A. Wilcox should be reinstated because Trump didn’t have the authority to fire her, but a special panel of the U.S. Court of Appeals for the District of Columbia Circuit stayed that opinion.

Wilcox told the D.C. Circuit Tuesday that the full court should hear her case because the special panel’s opinion rewrote US Supreme Court precedent. ...
