A federal judge declined to pause National Labor Relations Board proceedings against a Puerto Rican hospital, finding that federal law prevents the court from intervening.
Judge Aida M. Delgado-Colón of the US District Court for the District of Puerto Rico in a Wednesday opinion adopted a magistrate judge’s recommendations to deny Hospital Menonita Ponce Inc.'s request for a preliminary injunction against the board. The hospital had argued that removal protections for NLRB members and the agency’s administrative law judges unconstitutionally insulated them from presidential oversight.
