Supreme Court Passes on Challenge to Legality of Diversity Plans

Two White current and former Michigan police officers failed to convince the US Supreme Court to examine whether opposition to an employer’s initiative designed to boost workforce diversity is a protected activity under federal anti-bias law.

The justices on Monday declined to probe a November ruling by the US Court of Appeals for the Sixth Circuit that captain Michael Caldwell—who was demoted—and inspector Robert Hahn—who was fired—didn’t engage in protected activity when they complained about Michigan State Police’s racial and gender diversity program and advocated for White male employees.
