Texas Children’s Hospital and a Christian radiographer agreed to drop an appeal over religious accommodations for the worker’s flu shot opposition as they waited to see if the court would rehear the case.
The parties will bear their own attorneys’ fees and costs, the US Court of Appeals for the Fifth Circuit said Wednesday when it granted the unopposed motion to dismiss the appeal with prejudice. The appellate panel also vacated its 2-1 August opinion rejecting the worker’s attempt to overturn the district court’s grant of summary judgment in the hospital’s favor.
