The US Supreme Court declined to consider whether public sector unions are bound by the First Amendment because they receive money from the government in the form of union dues collected from workers.
The high court turned aside an issue that could have expanded the reach of its 2018 decision in Janus v. AFSCME, which held that the First Amendment bars mandatory nonmember union fees in the public sector.
The justice’s decision marks another loss for union foes who’ve been trying for years to expand the reach of Janus to disrupt organized labor.
