A passenger transit service won its bid to toss a lawsuit brought by the estate of an employee who died on the job after the appeals court confirmed the service wasn’t a railroad.

John Schroeder’s estate sought claims under the Federal Employers Liability Act after he was crushed to death between two train cars while working as a technician for the Port Authority Transit Corporation, which operates the Speed Line, a transit line from Philadelphia to Lindenwold, N.J.
