The Trump administration is pushing a D.C. federal court to dismiss former EEOC Democratic Commissioner Jocelyn Samuels’ lawsuit over her January firing, arguing Title VII of the 1964 Civil Rights Act allows the president removal power.
The Equal Employment Opportunity Commission doesn’t fall within the “narrow exceptions” to the president’s firing authority over agencies and Samuels’ “ultra vires claim is an unsuccessful Hail Mary pass,’” the DOJ attorneys representing the administration said in the motion filed Monday in the US District Court for the District of Columbia.
