ChowNow’s False Advertising Claims Against Rival Move Forward

ChowNow Inc. can pursue some of its false advertising claims against competitor Owner.com under both federal and state law, a district court ruled.

ChowNow sufficiently alleged Article III and statutory standing to pursue its false advertising claim under the Lanham Act and California’s unfair competition and false advertising laws, Magistrate Judge Virginia K. DeMarchi said Jan. 16 for the US District Court for the Northern District of California. DeMarchi partially denied Owner.com’s motion to dismiss ChowNow’s complaint, which alleged unfair and deceptive business practices in the restaurant digital platform market.
