Ohio Tax Foreclosure Damages Suit Tossed by State Appeals Court

A group of former homeowners can’t sue an Ohio county for damages from property tax foreclosures where the homes never sold at auction, and instead had to file mandamus claims to determine the compensation owed, the Ohio Court of Appeals held.

A trial court correctly dismissed the homeowners’ constitutional takings claim and inverse-condemnation claims, Judge Michelle J. Sheehan of the Ohio Court of Appeals, Eighth District said Dec. 24. The state’s tax-foreclosure scheme also isn’t an excessive fine in violation of the Ohio Constitution, she said.
