A disability services provider will get another chance to argue that its administrative building and vans are exempt from Winchester, Va., property taxes after a state appeals court vacated a trial court’s denial Tuesday.
The trial court’s order didn’t consider an intervening law defining exempt educational purposes to include special education and related services, the Virginia Court of Appeals said in an unpublished opinion. The trial court must make factual findings on remand about whether the property and vans were primarily used for those purposes, Judge Lisa M. Lorish wrote.
