West Virginia officials will face a narrowed lawsuit alleging that a state law banning most abortions unlawfully prevents access to a pregnancy-ending drug, a federal court said Thursday.
GenBioPro Inc., which makes a generic version of mifepristone, didn’t sufficiently allege that heightened federal regulations under the Food and Drug Administration Amendments Act take precedence over the state’s Unborn Child Protection Act insofar as the state law prevents doctors from prescribing the drug, the US District Court for the Southern District of West Virginia, said.
