Flipps Media Defeats Video-Privacy Suit Over Meta Info Sharing

A FITE TV digital streaming service consumer can’t revive a proposed class action alleging Flipps Media Inc. illegally disclosed users’ video-viewing histories to Meta Platforms Inc. in violation of the Video Privacy Protection Act, the Second Circuit said Thursday.

Lead plaintiff Detrina Solomon failed to allege that Flipps disclosed her “personally identifiable information” under the VPPA, the US Court of Appeals for the Second Circuit said. In ruling so, the court took a side in a circuit split over how that term is defined.
