Aetna Can’t Trim or Transfer Connecticut Fertility Coverage Suit

Aetna Life Insurance Co. failed to convince a federal judge that it wasn’t responsible for setting the terms of a health plan that’s accused of offering fertility treatment coverage that discriminates against LGBTQ+ patients.

There are ongoing factual disputes about the “extensive, collaborative effort” that led to the design of the health plan covering employees of Georgia hospital Wellstar Health System Inc., Judge Vernon D. Oliver said. He therefore declined to award Aetna partial summary judgment on the question of whether it was responsible for designing the plan.
