Elevance Denied Arbitration in Health Claim Overpayment Lawsuit

Elevance Health Inc. and related subsidiaries failed to secure arbitration of a dispute by Connecticut health funds that say the companies wrongly caused them to overpay for medical services.

Elevance—formerly known as Anthem Inc.—waived its right to arbitrate by seeking to dismiss the case on the merits, Judge Sarah F. Russell said March 20 for the US District Court for the District of Connecticut. The company’s decision to seek “full and final resolution” in court is “not consistent with the right to compel arbitration,” Russell said.
