Delta Air Lines Escapes Class Action Suit Over Overtime Wages

Delta Air Lines Inc. won’t have to face a proposed class action from a senior coordinator who says ground workers like him should’ve been paid overtime for working extra hours after swapping shifts.

Lukas Goodyear’s claim that Delta breached their contract fails because after the airline modified the terms of his employment, he implicitly accepted them when he stayed on the job, said Judge Thomas W. Thrash Jr. of the US District Court for the Northern District of Georgia.

Thrash on Thursday granted Delta’s motion for summary judgment, while denying as moot Goodyear’s request to certify a class.
