Two Missouri school workers sufficiently alleged an injury and can pursue a free-speech lawsuit over their school district’s anti-racism training, a sharply divided full Eighth Circuit ruled Tuesday.
The Springfield R-12 School District employees alleged “specific facts supported by evidence showing” they faced “a credible threat of adverse consequences by the school district” if they opposed its views on racism, a 6-5 court said following en banc rehearing in the case.
