Agency Approval of 2,500-Acre Oregon Logging Project Upheld (1)

The Bureau of Land Management undertook a proper risk assessment for endangered birds’ nesting grounds when it approved a 2,500-acre logging project in Oregon, a federal appeals court ruled Wednesday.

The agency, its National Environmental Policy Act review, reasonably explained how the Big Weekly Elk Project won’t disturb the habitat of the marbled murrelet, the US Court of Appeals for the Ninth Circuit said.

Cascadia Wildlands and Oregon Wild challenged the logging project in the US District Court for the District of Oregon, alleging BLM’s approval violated both NEPA and the Northwestern and Coastal Oregon Resource Management Plan.
