A Christian worker can pursue retaliation and wrongful termination claims against her former employer even though her religious beliefs don’t conflict with the disability rights organization’s policy on pronoun and name use.
The worker lost her job with Disability Rights California after she raised concerns about complying with the policy without compromising her religious beliefs, which is enough to advance her retaliation and wrongful firing claims, the US District Court for the Southern District of California said. But she didn’t show her beliefs required an accommodation, dooming her failure-to-accommodate allegations, the Tuesday order partly dismissing the case said.
