Amazon Gets Its Data Center Kickback Claims Revived on Appeal

Amazon.com Inc. won its appeal Tuesday to revive claims against two former employees, a real estate developer, and others over data center deals the company says were tainted by kickbacks.

The district court shouldn’t have granted summary judgment on the tech giant’s claims, given genuine disputes of material fact, the US Court of Appeals for the Forth Circuit said.

The US District Court for the Eastern District of Virginia tossed Amazon’s RICO, fraud, unjust enrichment, conversion, and civil conspiracy claims in April 2023.
