An injection well company lost its lawsuit challenging how Ohio and the EPA regulated necessary permits for its projects linked to oil and gas production.
Omni Energy Group LLC’s amended complaint was dismissed because its claims don’t meet the exemption requirements to overcome the Environmental Protection Agency’s sovereign immunity, the US District Court for the Southern District of Ohio said Wednesday.
Claims that the Ohio Department of Natural Resources violated federal statute were also dismissed because the injection well permits are governed by Ohio law, so federal law wouldn’t be the right mechanism to sue state actors, the court ruled. ...
