Exxon Loses Bid to Move California Plastic Suit to Federal Court

California’s plastics recycling deception case against ExxonMobil Corp. will proceed in state court after a judge shut down the company’s attempt to prove federal jurisdiction.

The oil and petrochemical giant failed to prove that the case had maritime, federal enclave, or federal officer jurisdiction, Judge Richard G. Seeborg said in an order filed Monday in the US District Court for the Northern District of California.

The decision is a win for California, which argued that the case should remain in state court since it doesn’t make any claims under federal law. ...
