The Maine Public Utility Commission can continue charging developers and contractors a monthly project fee for community solar ventures while companies litigate over the state’s energy cost law, a federal judge ruled.
The law known as LD 1777 and signed into law by Gov. Janet Mills (D) last year, “does not regulate land use or prevent plaintiffs from continuing to develop and generate solar power.” The state therefore isn’t imposing an unconstitutional financial condition to do business, Judge Stacey D. Neumann said for the US District Court for the District of Maine.
