Over 150 solar panel companies and contractors sued the Maine Public Utilities Commission alleging the state unconstitutionally overhauled a solar incentive program.
LD 1777, signed into law by Gov. Janet Mills (D) in June, violates the takings clause and the contracts clause of the US Constitution because it authorizes a non-tax project charge for community solar ventures and impairs the companies’ contractual relationships with residential and commercial customers, plaintiffs said Monday in a complaint filed in the US District Court for the District of Maine.
