An appeals court granted New Hampshire’s request to pause a judge’s earlier order preventing the state from ending its vehicle inspection and maintenance program, citing the likelihood the state will succeed in its legal fight with a contractor.
Gordon-Darby Holdings Inc., a contractor that did vehicle inspections for the state, sued New Hampshire officials last year, alleging the state was planning to end the inspection program without the Environmental Protection Agency’s approval. The company, in its lawsuit, argued New Hampshire didn’t follow the Clean Air Act by not submitting a new state implementation plan for handling ozone pollution.
