The US Supreme Court on Monday declined to hear Michigan Democratic Gov. Gretchen Whitmer’s argument that the state is immune from Enbridge Energy‘s lawsuit linked to the state’s effort to shut down the aging Line 5 oil and gas pipeline.
The decision is the latest in the sprawling litigation over Line 5, which transports crude oil and natural gas from Michigan to Canada. The project has provoked several lawsuits from the state and tribes as Whitmer seeks to protect the Straits of Mackinac where a portion of the pipeline crosses.
