Supreme Court Declines to Hear PG&E Challenge to Rate Incentives

The US Supreme Court on Monday declined to hear a case from Pacific Gas & Electric Co. challenging how the Federal Energy Regulatory Commission determines which utilities are eligible for incentives.

A 2006 FERC order said the commission would approve requests for rate incentives for public utilities that join or continue to be a member of an regional transmission organization or independent system operator.

This issue not only affects California utilities but those in other states that have enacted RTO mandates or are planning to.
