The California Air Resources Board’s March emergency rule saying its vehicle emissions limits remain in effect contravenes Congress and harms the US government’s interests in maintaining uniform fuel economy standards, the DOJ told a federal court.
CARB’s regulations “alter the composition” of what vehicles car makers produce in the US and shift “that composition toward increasing percentages of EVs,” which impairs “the interests of the United States in ensuring American consumers’ access to and choice of reliable, affordable motor vehicles,” the US argues in its amended complaint filed Tuesday.
