A New York federal district court granted summary judgment to directors of the New York State Office of Mental Health on a retaliation claim under 42 U.S.C. § 1983 and state law of a compliance specialist who allegedly suffered multiple adverse actions, including an unsatisfactory performance evaluation, in retaliation for filing discrimination complaints, finding that her well-documented performance issues constituted legitimate, non-retaliatory reasons for the evaluation.
