Doctor Claiming Political Prosecution Can Use Criminal Discovery

A former Texas Children’s Hospital doctor who says his prosecution for leaking medical records on gender-affirming care was politically motivated won his appeal to use criminal discovery materials to explore civil claims for wrongful prosecution.

The US Court of Appeals for the Fifth Circuit 2-1 reversed the denial of a joint motion to modify the order Oct. 24. The district court was owed no deference because it didn’t provide any explanation or reasoning for denying the unopposed motion, the majority said.
