Alliance Pipeline LP lost its bid Thursday to get the Eighth Circuit to reverse a lower court’s decision that reconsidered pipeline damages claims brought by agricultural landowners.
“Alliance has not pointed to any authority indicating the mere existence of an arbitration agreement provides an automatic right of immediate appeal,” the US Court of Appeals for the Eighth Circuit said.
As a result, “Alliance has not demonstrated a permissible basis for us to exercise jurisdiction over the district court’s reconsideration order” and “we lack the authority to decide the merits of this appeal,” ...
