London market insurers lost their bid to delay paying the Archdiocese of New York’s defense costs for sexual abuse claims until they are adjudicated or settled.
The London insurers’ coverage of defense costs is triggered when the archdiocese has paid its $100,000 per-occurrence retention in defending an underlying claim, the New York Supreme Court, New York County said in a Monday order.
The court ruled earlier this month that the insurers are on the hook up to their full policy limits—$200,000 per occurrence—for covered claims, and that the limits aren’t reduced by the retention.
