Pentegra Retirement Plan Litigants Rebuff Advisory Jury Prospect

An upcoming trial over the fees tied to a 401(k) plan administered by Pentegra Retirement Services Inc. shouldn’t include an advisory jury for the issues slated to be decided by a judge, the parties said in a joint court filing.

It wouldn’t save time or better resolve the case to have the jury that weighs the bulk of the lawsuit remain in place to hear issues that must be resolved by the judge, according to a joint letter filed Tuesday by the Pentegra plan’s directors and a class of more than 26,000 plan participants.
